Terms of Use

1. About these Terms

These Terms cover the Intentional journaling and creativity service, run by China M McNeil Izaguirre, 4800 Morris Lane, Oklahoma City, OK 73112, United States. Contact: Intentional44@gmail.com.

By accepting these Terms and using Intentional, you agree to them. You must be at least 18 years old to use Intentional.

Our Privacy Policy explains how we handle your information. Agreeing to these Terms is not consent to AI processing or anything else that needs separate permission.

2. The service

Intentional offers daily creative exercises, personal journaling, progress tracking, reminders, photo attachments and optional AI reflections on handwritten pages. You don't need an account, and your journal does not sync across devices.

Intentional is not medical care, therapy, diagnosis, treatment or an emergency service. Its prompts and reflections are creative tools, not professional advice or mental health assessments. If you need urgent help, contact your local emergency services.

3. Price

Intentional is currently free, with no subscriptions or in-app purchases. Your internet or mobile provider may charge for data.

If we add paid features, we will show the price, what you get and the billing terms before you buy. Accepting these Terms does not authorize any payment. Any future purchase will need your separate approval and will follow app store rules and consumer protection law.

4. Your content

You keep your rights to your journal text and photos. We do not own your journal.

When you use an online feature, you allow us to host, transmit and process your content as needed to provide it, as described in the Privacy Policy and subject to any consent the law requires. We will never use your journal in advertising. The Privacy Policy explains how providers may keep or further process your content.

Only upload content you have the right to share. Do not upload private information about someone else without their permission or another lawful basis. Who owns AI output depends on the law, and we do not guarantee it is unique or protected by copyright.

5. AI reflections

AI can misread handwriting, make things up, or produce inaccurate or unsuitable responses. Treat reflections as optional creative prompts, not facts or professional advice. You can decline AI processing and keep journaling by typing, or turn it off later in Settings → AI Reflections.

AI features are only available where the law and our provider's terms allow. Access to Intentional does not override provider age or regional limits. We may restrict or pause online features to comply with them.

6. Storage and deletion

Your journal can be lost if you clear app or browser storage, reset the app, or lose or replace your device. We cannot guarantee recovery. Keep your own copy of anything important and protect access to your device.

Uploaded images are stored separately on Base44. Settings → Data & Storage → Delete all data permanently deletes your uploaded photos and clears your local data. It does not erase records held by AI and infrastructure providers, as explained in the Privacy Policy. None of this waives our legal obligations or your privacy rights.

7. Acceptable use and intellectual property

Use Intentional lawfully. Do not try to gain unauthorized access, bypass access controls, disrupt the service, upload malware, abuse automated features or infringe anyone's rights. Nothing here prohibits conduct the law expressly protects.

The software, branding and original content of Intentional belong to us or our licensors. You may use them as part of normal use of the service, but you do not own them. Your content and third-party materials keep their own rights.

8. Availability and termination

We may maintain, update or change Intentional. Technical, device, network or provider problems can interrupt access and reminders. We do not guarantee uninterrupted service or that every reminder will arrive.

You can stop using the app at any time. Uninstalling does not delete server data. We may restrict online access when reasonably necessary to deal with a serious breach of these Terms, illegal activity, security threats or legal obligations. Where appropriate and lawful, we will tell you first and give you a chance to contact us. Ending access does not remove your privacy rights or obligations already owed.

Where practical, we will give reasonable notice before discontinuing anything that affects access to your content, subject to consumer law.

9. Warranties and liability

To the extent the law allows, Intentional is provided "as available," with no guarantee that it will be uninterrupted, error-free or produce any particular result. Your statutory warranties and remedies still apply.

To the extent the law allows, we are not liable for indirect or consequential losses from using the service. Nothing in these Terms limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability the law does not allow us to limit. These Terms do not waive your mandatory privacy or consumer rights.

10. Apple

For the iOS app, Apple's Standard Licensed Application End User License Agreement governs your license unless we provide a custom EULA through App Store Connect. These Terms do not override that license or app store rules. Apple does not run Intentional's journaling service. Send support questions to us.

11. Governing law and disputes

These Terms are governed by Oklahoma law, subject to any mandatory protections where you live. Nothing here takes away consumer rights that cannot be waived.

If you have a dispute, email Intentional44@gmail.com so we can try to resolve it. You can still seek legal relief, contact a regulator or go to any court available to you. There is no mandatory arbitration and no class-action waiver.

12. Changes and contact

We may update these Terms. We will give you notice of material changes and ask you to agree again where required. Changes do not take away rights you already have. If any part of these Terms is unenforceable, the rest still applies to the extent the law allows.
